BRIGGO, Inc. (“BRIGGO” or “we”, “us” or similar terms) is concerned about your privacy and wants you to be familiar with how it collects, uses and shares your information. This Privacy Policy describes the types of information we may collect from you or that you may provide whenever you sign up for or use the various BRIGGO services and products, including without limitation the BRIGGO Web site or any other Web site owned or operated by BRIGGO (the “Site”), the BRIGGO Smartphone Application, the BRIGGO Coffee Haus, text message and email notification services, telephone service, telephone and helpdesk support and/or point-of-sale purchase of beverages and other products and services offered by BRIGGO including BRIGGO Loyalty Points, BRIGGO BUCKS or other products or services offered by BRIGGO or any affiliate (collectively, the “Service”), and our practices for collecting, using, maintaining, protecting and disclosing such information. Some of this information is collected automatically and some is collected only when you provide it voluntarily. Any capitalized term used herein but not defined will have the defined meaning given to such term in our Terms of Use.

This Privacy Policy applies to information we collect on or through the Service. It does not apply to information collected by (i) us offline or through any other means, including on any other website operated by BRIGGO; or any third party, including through any third party website, application or content (including advertising) that may link to or be accessible from the Service. Please see the section entitled “Links to Third Party Sites” below for more information on Third Party Sites.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Service. By accessing or using our Service, you agree to this Privacy Policy. This Privacy Policy may change from time to time (see Section entitled “Acceptance of Privacy Policy” below).

A SPECIAL NOTE ABOUT CHILDREN

BRIGGO is not designed or intended for use by children under 13. Children under 13 may not submit any Personally Identifiable Information (as defined below) to us, and if we discover that we have inadvertently gathered any such information from a child under 13, we will take appropriate steps to delete it.

In addition, persons under 18, should use BRIGGO only with involvement of a parent or guardian.

ANTI-SPAM POLICY

BRIGGO is 100% opposed to unsolicited commercial email (“spam”). We do not have any desire to send unsolicited marketing emails to anyone without permission and we do not sell or provide email addresses to any unauthorized third party in violation of this Privacy Policy. If you receive any unsolicited emails from spammers, please be assured that BRIGGO did not provide your email address to such parties.

This does not mean that we can prevent spam from happening on the Internet. Unfortunately, spammers obtain email addresses in a number of devious ways, including when you respond and ask to be taken off a spam email list, and in some cases by just generating emails to millions of random email addresses in the hope of getting a few “live” ones. Please be assured that at BRIGGO we hate spam as much as you do, and we do our best to avoid contributing to it.

All of our newsletters and other general email marketing communications also include an “unsubscribe” opt-out link that you may use to ask that we discontinue such emails to you. (Even if you opt-out of our newsletter or other marketing communications, we may still send you certain transactional or administrative emails, such as email or text confirmations of product purchases, or emails regarding changes to your account.)

If you believe that you have gotten unsolicited email from us, please contact us at baristabotsupport@costacoffee.com and we will investigate. Please be assured that we strive not to contact anyone for marketing purposes without permission, and if you prefer not to receive any further marketing communications from us, just tell us and we’ll try to make sure you never hear from us again.

WHAT TYPES OF INFORMATION DOES BRIGGO COLLECT?

Personally Identifiable Information.

Personally Identifiable Information is information that identifies you as an individual, such as your name, mailing address, phone number, email address, credit/debit card number and expiration date (or other payment-method information), login ID, member name and password. When you sign up for or use the Site or other Service, BRIGGO collects some amount of Personally Identifiable Information from you. BRIGGO also collects Personally Identifiable Information that you may voluntarily provide when you use the Site or other Service, that you may disclose in a public area of the Site or other Service (such as a rating/review page, message board, chat room, social network), or that you may include if you communicate with BRIGGO. In addition, when you use certain features of the Site or other Service, BRIGGO may collect other Personally Identifiable Information of others that you may provide.

Non-Personally Identifiable Information.

BRIGGO collects information from you automatically when you use the Site or other Service. The information that BRIGGO collects automatically does not contain Personally Identifiable Information, but we may maintain it or associate it with personal information we collect from you or in other ways or receive from third parties. The automatically collected information may include information about your device, browsing actions and patterns, including (i) details of your interactions with the Site or other Service (such as pages, content or resources that you access, product preferences (e.g., the drink formulations selected) and locations where you picked up your drinks), (ii) traffic data, location data, logs and other communication data, and (iii) your browser type, IP address, and operating system. BRIGGO also collects information that does not include Personally Identifiable Information when you voluntarily provide it (such as in response to a questionnaire or survey) or post it to a public area of the Site or other Service (such as a rating/review page, message board, chat room or social network). Information we collect automatically helps us to provide and improve the Service and to deliver a better and more personalized Service, including by enabling us to (a) estimate our audience size and usage patterns, (b) analyze and monitor the use, relevancy and functionality of our Service, (c) store information about your preferences, allowing us to customize our Service according to your individual interests, and (d) recognize you when you return to our Service.

HOW DOES BRIGGO AUTOMATICALLY COLLECT INFORMATION?

Cookies.

A cookie is a message that is sent to your computer from a Web server and stored on your computer’s hard drive. You may refuse to accept any cookies issued by BRIGGO by activating the appropriate setting on your browser or device. However, if you select this setting you may be unable to access certain features or functionality of the Service. Unless you have adjusted your browser/device setting so that it will refuse cookies, our system may issue cookies when you direct your browser to our Site or interact with the Service. BRIGGO may use cookies that contain Personally Identifiable Information, such as your Login ID and your email address. This would allow you to log in automatically and to ensure that you have agreed to the terms, conditions and policies that govern your use of the Site or other Service. In addition, BRIGGO may use cookies to track your use of the Site or other Service in order to provide you with a more personalized user experience by better understanding your preferences and interests.

Web Beacons.

Pages of websites included in our Service and/or our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs. pixel tags and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an e-mail and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

Payment Card Readers and User Interface.

When you create an account at BRIGGO or use a payment card to purchase a BRIGGO product, Personally Identifiable Information is collected at the point of entry on our secure Site or from the magnetic stripe on your card. That information is immediately encrypted and transmitted to the BRIGGO datacenter where the already encrypted information is sent through a one-way cipher (it does not allow BRIGGO to reverse the process and read your Personally Identifiable Information). That ciphered information is then sent to BRIGGO’s third party payment processor where the charges for your product are cleared through Visa, MasterCard, American Express, Diners Club and other credit and debit providers for deposit in BRIGGO’s bank account. The third party payment provider stores the cipher which is used by BRIGGO to recall your “favorited” products and preferences to provide you with a more personalized experience and system ease of use. BRIGGO offers a loyalty drink program in which returning users receive free products after meeting certain thresholds. Account holders can also create a “pickup” name which allows convenient identification when mobile users visit a product pickup point to retrieve their purchase. The cipher does not allow BRIGGO to use or read any Personally Identifiable Information until you return to one of the BRIGGO Sites or use the Service and use the same payment card used during a prior visit.

HTML5 Local Storage.

HTML5 Local Storage is a feature of the thin client markup language used by BRIGGO to create all user interfaces. Local Storage allows the client software to retain information about browsing history on the BRIGGO site. This information is used to enhance the local client experience and is not shared or stored centrally on BRIGGO computer systems.

IP Address.

An IP address is a number that is assigned to your computer automatically when you use the Internet. BRIGGO does not currently log your IP address. In the future, BRIGGO may log your IP address when you use the Site or other Service. This information will not be stored with any Personally Identifiable Information on BRIGGO computer systems or networks. This information would be used for statistical purposes only.

Pixels.

Pixels, also called clear GIFs, are invisible files on Web pages that you visit. When you visit a page on a website that contains a pixel, the pixel communicates with your computer to determine, among other things, whether you have been to that page before or viewed a particular advertisement. BRIGGO does not currently use pixels. In the future, BRIGGO may use pixels to serve advertising, enhance email advertising, and track usage of the Site or other Service.

Other Methods.

We may receive information about you from our business partners, including (i) service providers that furnish us with analytical information on users of the Service and (ii) social networking services (such as Facebook or Twitter) through which you may be permitted to interact with the Service. These third parties may use cookies alone or in conjunction with other tracking technologies to collect information about you. We use the information provided to us by these third parties consistent with this Privacy Policy, and you hereby consent to our use of such information in such manner. We do not control how these third parties themselves use or disclose the information they collected from or about you, nor is any such third party’s use or disclosure of such information subject to this Privacy Policy.

In particular, the Service uses Google Analytics (a web analytics service provided by Google, Inc.). Google Analytics uses cookies to collect information such as URLs, Internet domain and host names, browser software, and the date and time that the Site is visited. This information is used to monitor the effectiveness of the Service and to consider potential improvements to the Service. The information collected is Non-Personally Identifiable Information and is transmitted to and stored by Google on its servers. HOW DOES BRIGGO USE THE INFORMATION?

In general, we may use information that we collect about you or that you provide to us in order to operate and provide the Service, to develop and improve the Service and our other products and services, to communicate with you and provide additional information that may be of interest to you, to provide you with other information, products or services that you request from us, to provide you with customer support, technical support, or administrative, account and security notices, including notice of changes to our Terms of Use or Privacy Policy or the products and services that we offer, to conduct our administrative and internal business operations, to fulfill any other purpose for which you provide it, to comply with our obligations (as determined by us in good faith) under applicable law, to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, and for any other purpose with your consent. By way of illustration, we may use Personally Identifiable Information and Aggregated Information as follows:

Personally Identifiable Information.

BRIGGO uses your Personally Identifiable Information to notify you of changes to the Site or other Service, to respond to your customer service inquiries, communicate with you about your purchases, and to allow you access to your “favorited” products, your product history, and your loyalty card information. BRIGGO uses this information to request your participation in surveys or other promotions. You can choose not to receive certain communications from BRIGGO as described in the section below entitled “Receiving Communications and Opting Out.” BRIGGO also uses your Personally Identifiable Information to process and fulfill your purchases, provide you with information that you request, and deliver content to you that is relevant to your interests.

Aggregate Information.

BRIGGO combines your usage information for the Site or other Service with that of other users to determine which features and areas of the Site or other Service are most popular. By collecting and analyzing this data, BRIGGO can improve the Site or other Service. This “Aggregate Information” does not contain any of your Personally Identifiable Information.

WHO DOES BRIGGO SHARE INFORMATION WITH?

Personally Identifiable Information.

BRIGGO may share your Personally Identifiable Information with others with your consent. BRIGGO may also share your Personally Identifiable Information with affiliates and companies that provide support services to us (such as credit card processors or website hosts). These companies may use information about you to perform their functions on our behalf. In the event of a merger, acquisition, financing, divestiture, restructuring, reorganization, dissolution, sale of assets or any other situation involving the transfer of some or all of our business assets, BRIGGO may disclose your Personally Identifiable Information to those involved in the negotiation or transfer. We may also share your Personally Identifiable Information to fulfill the purpose for which you provide it, or for any other purpose disclosed by us when you provide the information. Finally, BRIGGO may disclosure your Personally Identifiable Information to comply with any court order, law or legal process, including to respond to any government or regulatory request, to enforce or apply our Terms of Use, Privacy Policy and other agreements, or if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of BRIGGO, our customers or others.

Aggregate Information.

BRIGGO may disclose Aggregate Information and information that does not identify any individual, without restriction. Without limiting the foregoing, we may disclose Aggregate Information with potential partners, advertisers, investors and other interested third parties in connection with the marketing of BRIGGO’s products and services without restriction, as long as such information does not include any of your Personally Identifiable Information.

Selling and Renting Information.

BRIGGO does not sell or rent your Personally Identifiable Information to third parties. However, in the event that you expressly opt-in via the Site or other Service to receive particular products or services, or information about products or services, that are offered by third parties, or otherwise authorize us to do so, we will share your Personally Identifiable Information with those third parties as appropriate for those limited purposes. BRIGGO may also share with those same third parties certain limited personal information that, without other information, does not specifically identify you.

Sharing with Social Networks or Other Sites You May Authorize.

If you are a member of a social network service (such as Facebook, Instagram, etc.) or you use other Internet sites where you have authorized them to gather information about your online behavior on BRIGGO (for instance, to notify your friends that you enjoyed one of our products or the experience, including participation in any behavioral reporting program that they may operate on or off of their own site (i.e., Facebook Beacon, etc.)), BRIGGO allows you to set up an account through credentials you store in your social network accounts (i.e. Facebook, Twitter, etc.). BRIGGO may share with third party social networks Personally Identifiable Information, and other information regarding your activities on our Site or other Service that may be associated with Personally Identifiable Information third party social networks already have about you (such as your Facebook Profile), and such third party social networks may use such information to improve their site or services, to provide us with data to improve our understanding of our customer base, or for other purposes. BRIGGO does not control the privacy policies of such third parties, and their privacy policies will govern their use of your information once it has been transmitted by BRIGGO. BRIGGO assumes no responsibility or liability for the actions of such third parties with respect to their use of your information or otherwise. Accordingly, make sure you are aware of and comfortable with the privacy policies of any third parties that you authorize to gather information from BRIGGO or information they provide to BRIGGO with your permission.

The Service may contain links to other sites, resources and information provided by Vendors and other third parties (collectively, “Third Party Sites”), including links (such advertisements) to Third Party Sites embedded or otherwise contained on the Site or Service. Links to these Third Party Sites are provided solely as a convenience to you, and the Third Party Sites are not a part of the Offerings. BRIGGO does not operate, own or control the Third Party Sites. You acknowledge and agree that your access to and use of the Third Party Sites is subject solely to the applicable terms and conditions of use (including, without limitation, privacy policies), if any, of the Third Party Sites. Our Privacy Policy does not apply to your access to or use of Third Party Sites. If you decide to access or use any Third Party Sites, you should review the privacy policies (if any) of the Third Party Sites to understand their policies regarding the collection and use of information about you.

WHAT OPTIONS DO I HAVE TO CONTROL THE USE OF MY INFORMATION?

Receiving Communications and Opting Out.

During registration and certain purchases, you can “opt out” of receiving certain communications from BRIGGO and our partners. Also, you can later “opt out” by sending a message to baristabotsupport@costacoffee.com requesting that your account be closed and all Personally Identifiable Information be deleted except for transaction history needed for statutory reasons. If you find that any information regarding your account is missing or incorrect, please contact baristabotsupport@costacoffee.com for instructions on how to correct errors or omissions. We may not accommodate a request to change information if we believe the change would violate any law or cause the information to be incorrect. We will respond to your request within 30 days from the date you contact us.

WHAT ELSE SHOULD I KNOW ABOUT PRIVACY?

Security.

We maintain security measures in place in order to attempt to protect against the accidental loss, and from unauthorized access, use, alteration and disclosure of the Personally Identifiable Information. We will comply with our obligations (including any disclosure and notice obligations) under applicable U.S. law relating any breach of the security, confidentiality or integrity of your personal information. Please be advised, however, that the Internet and other various networking communication media are not entirely secure, and your information may therefore be subject to interception or loss which is beyond our control. Accordingly, BRIGGO assumes no responsibility or liability for disclosure of your information (personally identifiable or otherwise) due circumvention of any privacy settings or security measures with respect to our Service or systems.

Disclosure of Information in Public Areas.

If you voluntarily disclose Personally Identifiable Information in a public area of the Site or other Service, such as a rating/review page, chat room, message board or social network, that information may be collected and used by a third party to send you unsolicited messages, advertisements or for other purposes. BRIGGO does not control the actions of users in public areas of the Site or other Service. If you disclose Personally Identifiable Information in a public area, you do so at your own risk.

YOUR CALIFORNIA PRIVACY RIGHTS (CALIFORNIA RESIDENTS).

California Civil Code Section 1798.83 permits our visitors who are California residents to request certain information regarding its disclosure of personal information to third parties for their direct marketing purposes. ACCEPTANCE OF PRIVACY POLICY

When you use the Site or other Service, you are accepting the terms and conditions of this Privacy Policy, and BRIGGO will have the right to use your Personally Identifiable Information or other information about you as described in this Privacy Policy. If you do not agree to have your information used in any of the ways described in this Privacy Policy, you must not use the Site or other Service and you must follow the opt-out provisions above. BRIGGO reserves the right to modify this Privacy Policy at any time. You are responsible for periodically visiting our Site and this Privacy Policy to check for any changes to the Privacy Policy.
